La Eurocámara aprueba prohibir el roaming por usar móvil en extranjero desde diciembre de 2015

La Comisión de Industria de la Eurocámara ha aprobado este martes -por 30 votos a favor, 12 en contra y 14 abstenciones- el paquete legislativo para prohibir el recargo tarifario por el uso del móvil en el extranjero (roaming), tanto para las llamadas como para los mensajes de texto o para navegar por Internet, como muy tarde a partir del 15 de diciembre de 2015.

Los eurodiputados han respaldado además reglas más estrictas para impedir que las compañías de telecomunicaciones puedan bloquear o ralentizar servicios rivales como Skype o Whatsapp, reforzando así la neutralidad de la red.

Las reglas chocan con las grandes operadoras europeas, como Telefónica, France Telecom o Deutsche Telekom, que alegan que la supresión del “roaming” reducirá sus ingresos y se traducirá en un recorte de las inversiones necesarias para desplegar las nuevas redes de fibra óptica.

El paquete legislativo se votará en el pleno de la Eurocámara los días 2 y 3 de abril, pero su futuro es todavía incierto porque justo ahora concluye la legislatura y las prioridades del próximo Parlamento que salga de las elecciones del 25 de mayo podrían cambiar. Además, los Gobiernos todavía no han alcanzado un acuerdo entre ellos para negociar con los eurodiputados. La comisaria de Telecomunicaciones, Neelie Kroes, ha dicho en un comunicado que espera un acuerdo a finales de 2014.

A juicio de Kroes, el voto en el Parlamento "nos lleva paso más cerca de poner fin al recargo por “roaming” en la UE". Para la eurodiputada del PP Pilar del Castillo, ponente del paquete legislativo, se trata de "un gran paso adelante para consolidar el mercado único de telecomunicaciones".

En todo caso, para proteger a las compañías frente a "un uso anómalo o abusivo de los servicios de itinerancia minoristas", los eurodiputados han pedido a la comisión que elabore directrices sobre casos excepcionales en los que los operadores estarían autorizados a aplicar recargo. No obstante, estos recargos estarían por debajo de los topes que ya fijan las normas de la UE sobre "roaming".

The Industry Commission of the Europarliament passed a vote on Tuesday –by 30 votes in favor, 12 against and 14 abstentions- to prohibit roaming charges for customers who use their cell phone abroad, including calls, text messages or connecting to the internet, by the 15th of December, 2015 at the latest.

The euro MPs also have backed tougher rules to prevent telecom companies from blocking or slowing rival services such as Skype or WhatsApp in order to reinforce the neutrality of the internet.

The rules don´t sit well with the big European operators,
like Telefónica, France Telecom or Deutsche Telekom,
who say that eliminating roaming will reduce their income and will lead to a reduction in the capital investments necessary to roll out the new fiber optic networks.

The European parliament will vote on the legislative package in the next plenary session the 2nd and 3rd of April but it´s future is still undetermined because the legislative session is about to conclude and the Parliament´s priorities could change with the upcoming elections on the 25th of May. Furthermore, the EU governments have yet to reach an agreement among themselves in order to negotiate with the euro MPs. The EU Telecommunications Commissioner, Neelie Kroes, made a statement saying she hoped for an agreement by the end of 2014.

Kroes believes that the Parliement´s vote “brings us one step closer to ending the roaming charges in the EU.” For the Popular Party´s (Spain) euro-diplomat Pilar del Castillo, who´s in favor of the bill, it´s a “big step forward in consolidating the single telecommunications market”.

However, in order to protect the companies against “an anomalous or abusive use of small-time roaming service providers”, the euro-diplomats have asked the Commission to establish a set of directives on the exception cases in which operators would be authorized to charge roaming fees. Nevertheless, these charges would be under the limits that currently set the EU rule on roaming.
